A todos los comparecientes y/o visitantes:
En términos de la Ley Federal de Protección de Datos Personales en Posesión de los Particulares publicada en el Diario Oficial de la Federación el 20 de marzo de 2025, y posteriormente modificada (en lo sucesivo la ”LFDPPP”), el presente aviso de privacidad integral se pone a disposición de la persona titular de los datos personales a partir del momento en que estos son recabados, en cumplimiento de los artículos 2, 7, 8, 10, 12, 13, 14, 15, 19 y 20 de la LFDPPP.
Al acceder a nuestros servicios y proporcionar sus datos personales, usted otorga su consentimiento expreso para el tratamiento y protección de sus datos personales, de conformidad con los siguientes términos y condiciones.

Datos personales que recabamos de Usted y que serán sometidos a tratamiento
Como solicitante o parte de algún servicio notarial o trámite efectuado en la Notaría 123 de Quintana Roo, o bien, como visitante de la misma, se le podrán solicitar los siguientes datos, que serán tratados con el presente consentimiento expreso, conforme al artículo 8 de la LPDPPP:
- Nombre, domicilio, fecha y lugar de nacimiento, estado civil, ocupación, comprobantes de domicilio, registro federal de contribuyentes, Clave Única de Registro de Población, estado civil, relaciones de parentesco, firma, entre otros.
- Correo electrónico y número telefónico.
- Información relacionada con bienes inmuebles, datos fiscales o bancarios, tales como cuentas bancarias, créditos, bienes muebles e inmuebles, activos, pasivos, entre otros.
- Comprobantes oficiales que acrediten su identidad y la información que usted declara.
- Misma información arriba mencionada, sobre su cónyuge, herederos, legatarios y beneficiarios.
- Fotografía/imagen, dactilogramas y datos de audio, según sea necesario en los procesos de otorgamiento y firma, mismos que serán tratados como datos sensibles.

¿Con qué finalidades usamos y tratamos sus datos personales?
El suscrito responsable recaba y tratará sus datos personales, con fundamento en el artículo 15, fracción III, de la LPDPPP, y en observancia a los principios establecidos en la misma, para el cumplimiento de las siguientes finalidades:
1. Finalidades primarias: Para la prestación de servicios conforme a la legislación aplicable, entre lo que se encuentran integrar expedientes notariales, preparar escrituras, actas, certificaciones y demás instrumentos públicos, cumplir obligaciones ante autoridades competentes, verificar identidad, capacidad y legitimación jurídica y mantener registros y archivos notariales conforme a la ley.
Dichos actos comprenden, entre otros, operaciones traslativas de dominio como compraventas, donaciones, permutas, adjudicaciones por herencia o remate; así como fideicomisos, constituciones de regímenes de propiedad en condominio, testamentos, trámites sucesorios, hipotecas, cancelaciones de hipotecas, ratificaciones de firmas, fes de hechos y cotejo de documentos.
2. Finalidades secundarias: Adicionalmente, y únicamente con el consentimiento previo del titular, sus datos podrán ser tratados para fines estadísticos institucionales, mejora del servicio y difusión gremial. En su caso, estos fines podrán realizarse mediante el uso de datos que hayan sido previamente disociados, conforme a lo dispuesto en la fracción III del artículo 9 de la LPDPPP.
El tratamiento de los datos se limitará exclusivamente al cumplimiento de las finalidades antes descritas, siendo necesario, adecuado y relevante, conforme a lo establecido en el artículo 12 de la LPDPPP. Procuramos que los datos personales sean exactos, completos, correctos y actualizados, conforme al artículo 10 de la misma, y hemos adoptado medidas razonables para verificar y mantener su veracidad para los fines previstos.

¿Con quién compartimos su información y para qué fines?
Sus datos personales sólo son tratados por el responsable y el personal adscrito a esta Notaría, a efecto de elaborar los instrumentos públicos notariales que usted solicita o es parte. Por lo cual, sus datos personales no se transfieren a ningún tercero ajeno a ella, salvo para el cumplimiento de obligaciones legales ante instituciones financieras y/o autoridades competentes, tales como autoridades tributarias, administrativas, ministeriales, registrales y/o judiciales.
Toda persona que intervenga en cualquier fase del tratamiento de sus datos personales estará obligada a guardar estricta confidencialidad, incluso después de concluida su relación con el responsable, de conformidad con el artículo 20 de la LPDPPP.
Los datos personales podrán ser transferidos, sin requerir consentimiento, a instituciones financieras y/o autoridades tributarias, administrativas, ministeriales, registrales y/o judiciales e, cuando ello sea legalmente exigido o necesario para la formalización de actos notariales. Para otros supuestos, se solicitará consentimiento expreso, en los casos que así proceda, conforme a lo dispuesto en los artículos 35 y 36 de la LPDPPP.

¿Cómo limitar el uso o divulgación de los datos e información personal y ejercer sus derechos ARCO a su tratamiento?
Usted o, en su caso, su representante legal, podrá limitar el uso o divulgación de sus datos, ejercer los derechos ARCO (de acceso, rectificación, cancelación y oposición) conforme al artículo 28 y 31 de la LPDPPP, y efectuar la revocación del consentimiento para su tratamiento a través de los siguientes medios:
- presentando solicitud personalmente por escrito en nuestro domicilio dirigida a la responsable, o
- enviando un correo electrónico a la siguiente dirección: info@notaria123.com, mediante correo electrónico previamente registrado.
Dicha solicitud deberá cumplir con los requisitos y elementos contenidos del artículo 28 de la LPDPPP y ejercicio de estos derechos será gratuito en los términos del artículo 34 de la misma.
Lo anterior, en el entendido que una vez plasmados en un instrumento notarial, no podrá usted ejercer sobre ellos ninguno de los referidos derechos, pudiendo hacerlo solamente respecto de los que se conservan en la base de datos de esta notaría, en términos de lo despuesto en el artículo 25 de la LPDPPP.

¿Qué pasa con sus datos una vez que haya dejado de ser necesario su tratamiento?
Cuando los datos personales hayan dejado de ser necesarios para el cumplimiento de las finalidades previstas en el presente aviso de privacidad y que motivaron su tratamiento, conforme a las disposiciones legales aplicables, serán suprimidos de la base de datos de esta notaría previo bloqueo, en su caso, y una vez que concluya el plazo de conservación de los mismos conforme a lo establecido por la legislación mexicana.

Medidas de Seguridad
Adoptamos medidas administrativas, técnicas y físicas que garanticen la protección de sus datos personales frente a daño, pérdida, alteración o uso no autorizado. Uso de herramientas de Inteligencia Artificial
La Notaría podrá utilizar herramientas de inteligencia artificial como apoyo para la gestión, organización, extracción de información o análisis de documentos y datos personales, exclusivamente para facilitar procesos administrativos y operativos relacionados con la prestación de los servicios notariales.
El uso de dichas herramientas se realizará bajo la supervisión del personal autorizado y no sustituirá la valoración, revisión o decisión humana cuando ésta sea necesaria conforme a la naturaleza del servicio notarial.
En todo momento, la Notaría implementará las medidas de seguridad administrativas, técnicas y físicas necesarias para proteger los datos personales contra daño, pérdida, alteración, destrucción o el uso, acceso o tratamiento no autorizado, de conformidad con lo previsto en la LPDPPP y demás disposiciones aplicables.

Pursuant to the Federal Law on the Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares), published in the Official Gazette of the Federation (Diario Oficial de la Federación) on March 20, 2025 (hereinafter referred to as the “Law”), as amended from time to time, this Privacy Notice is made available to the data subject from the moment their personal data is collected, in compliance with Articles 2, 7, 8, 10, 12, 13, 14, 15, 19, and 20 of the Law.
By accessing our services and providing your personal data, you expressly consent to the processing and protection of your personal data in accordance with the following terms and conditions.

Personal Data collected and subject to processing
As an applicant or party to notarial services or any procedure carried out before Notary Public No. 123 of the State of Quintana Roo, or as a visitor to our offices, we may request the following personal data, which will be processed pursuant to your express consent and in accordance with Article 8 of the Law:
- Name, address, date and place of birth, marital status, occupation, proof of address, Federal Taxpayer Registration Number (RFC), CURP, marital status, family relationship, signature, among other information.
- Email address and telephone number.
- Information relating to your real property, tax, financial, and banking matters, including bank accounts, loans or credit facilities, movable and immovable assets, liabilities, and other proprietary or financial information.
- Official documents proving your identity and the information provided by you.
- Photograph, fingerprints, and audio data, as needed during execution and signing processes, which shall be treated as sensitive personal data.

For what purposes do we use/process your Personal Data?
The undersigned Data Controller collects and processes your personal data pursuant to Article 15, Section III, of the Law, and in accordance with the principles established therein, for the following purposes:
1. Primary Purposes: For the provision of notarial services in accordance with applicable laws and regulations, including, without limitation, the preparation and integration of notarial files and records; the drafting, execution, and issuance of deeds, instruments, certifications, certificates, and other public instruments; the fulfillment of legal and regulatory obligations before competent authorities; the verification of identity, legal capacity, and legal standing of the relevant parties; and the maintenance, preservation, and safeguarding of notarial records and archives in accordance with applicable law.
Such acts include, among others: Transfers of ownership, including purchase and sale transactions, donations, exchanges, inheritance adjudications, and foreclosure adjudications; trust agreements; establishment of condominium property regimes; wills; succession proceedings; mortgages and mortgage cancellations; signature ratifications; notarial certifications of facts and certification and comparison of documents.
2. Secondary Purposes: Additionally, and only with the prior consent of the data subject, their personal data may be processed for institutional statistical purposes, service improvement, and professional or industry-related communications. Where applicable, these purposes may be carried out through the use of data that has previously been anonymized or dissociated, in accordance with Section III, of the Law.
The processing of personal data shall be limited exclusively to the fulfillment of the purposes described above and shall be necessary, appropriate, and relevant in accordance with Article 12 of the Law. We seek to ensure that personal data is accurate, complete, correct, and updated, in accordance with Article 10 of the Law, and we have adopted reasonable measures to verify and maintain its accuracy for the intended purposes.

With whom do we share your information and for what purposes?
Your personal data is processed exclusively by the Data Controller and the personnel assigned to this Notary Public Office for the purpose of preparing the public notarial instruments requested by you or where you are a party to. Your personal data will not be transferred to any third party unrelated to this office, except when necessary to comply with legal obligations before financial institutions and/or competent authorities, including tax, administrative, prosecutorial, register and judicial authorities.
Any person involved in any stage of the processing of your personal data shall be required to maintain strict confidentiality, even after their relationship with the Data Controller has ended, in accordance with Article 20 of the Law.
Personal data may be transferred, without requiring consent, to financial institutions and/or competent authorities, including tax, administrative, prosecutorial, register and judicial authorities, when legally required or necessary for the formalization of notarial acts. For any other transfer of personal data, express consent shall be requested when applicable, in accordance with Articles 35 and 36 of the Law.

How can you limit the use or disclosure of your data and exercise your arco rights regarding the processing of personal data?
You, or your duly authorized legal representative, as applicable, may exercise your rights of access, rectification, cancellation, and objection (“ARCO Rights”), as well as limit the use or disclosure of your personal data and revoke your consent for the processing thereof, in accordance with Articles 28 and 31 of the LFPDPPP and other applicable provisions, through the following means:
- a) By submitting a written request in person at our address, addressed to the person responsible for the protection and processing of personal data; or
- b) By sending an email to the following address: info@notaria123.com, from the email address previously registered for such purpose.
Such request must comply with the requirements and elements set forth in Article 28 of the LPDPPP, and the exercise of these rights shall be free of charge in accordance with Article 34 thereof.
Notwithstanding the foregoing, once the relevant personal data has been incorporated into a notarial instrument, as applicable, you shall not be entitled to exercise any of the aforementioned rights with respect to such data contained in said public instrument. Such rights may only be exercised in relation to personal data that remains stored in the databases maintained by this Notary’s Office, pursuant to Article 25 of the LPDPPP.

What happens to your data once it is no longer necessary for processing?
When personal data is no longer necessary to fulfill the purposes established in this Privacy Notice and that justified its processing under applicable legal provisions, it shall be deleted from this notary’s database, following the applicable blocking period, if any, and once the legally established retention period has concluded, in accordance with the provisions of Mexican law..

Use of Artificial Intelligence tools
The Notary Office may implement and use artificial intelligence tools as technological support resources for the management, organization, classification, extraction of information, processing, and analysis of documents and personal data, solely for purposes related to improving and facilitating administrative and operational processes associated with the provision of notarial services.
The use of artificial intelligence tools shall be conducted exclusively under the supervision and control of duly authorized personnel. Such tools shall not replace the professional judgment, analysis, review, or decision-making responsibilities of the Notary or authorized personnel whenever human intervention is required due to the nature, legal implications, or characteristics of the notarial service provided.
The Notary Office shall adopt and maintain appropriate administrative, technical, and physical security measures designed to safeguard personal data against damage, loss, alteration, destruction, unauthorized access, disclosure, use, or processing, in accordance with the provisions of the Law and any other applicable legal provisions.

März 2025 im Amtsblatt der Föderation veröffentlicht und in seiner geänderten Fassung (im Folgenden „LFDPPP“), wird diese umfassende Datenschutzerklärung den betroffenen Personen ab dem Zeitpunkt der Erhebung ihrer personenbezogenen Daten in Übereinstimmung mit den Artikeln 2, 7, 8, 10, 12, 13, 14, 15, 19 und 20 des LFDPPP zur Verfügung gestellt.

Personenbezogene Daten, die wir von Ihnen erheben und die verarbeitet werden
Als Antragsteller oder Beteiligter an einer notariellen Dienstleistung oder einem notariellen Verfahren, das bei der Notaría 123 de Quintana Roo durchgeführt wird, oder als Besucher derselben, können von Ihnen die nachfolgend aufgeführten personenbezogenen Daten erhoben werden.
Diese Daten werden auf Grundlage Ihrer ausdrücklichen Einwilligung gemäß Artikel 8 der LFDPPP verarbeitet:
- Name, Anschrift, Geburtsdatum und Geburtsort, Familienstand, Beruf, Wohnsitznachweise, Steueridentifikationsnummer (Registro Federal de Contribuyentes), persönliche Identifikationsnummer (Clave Única de Registro de Población), familiäre Beziehungen, Unterschrift sowie weitere erforderliche personenbezogene Daten.
- E-Mail-Adresse und Telefonnummer.
- Informationen im Zusammenhang mit Immobilien, steuerlichen oder bankbezogenen Daten, einschließlich Bankkonten, Krediten, beweglichen und unbeweglichen Vermögenswerten, Aktiva, Passiva sowie sonstigen vermögensbezogenen Informationen.
- Amtliche Nachweise zur Identifizierung Ihrer Person sowie zur Bestätigung der von Ihnen gemachten Angaben.
- Die vorgenannten Informationen in Bezug auf Ihren Ehepartner, Ihre Erben, Vermächtnisnehmer und Begünstigten.
- Fotografien/Bildaufnahmen, Fingerabdrücke (Dactyloskopiedaten) sowie Audiodaten, soweit dies für Verfahren der Beurkundung und Unterzeichnung erforderlich ist. Diese Daten werden als sensible personenbezogene Daten behandelt.
[Artikel 15 Absatz II der LFDPPP]
Zu welchen Zwecken verwenden bzw. verarbeiten wir Ihre personenbezogenen Daten?
Der Verantwortliche erhebt und verarbeitet Ihre personenbezogenen Daten gemäß Artikel 15 Absatz III der LFDPPP sowie unter Einhaltung der darin festgelegten Grundsätze zur Erfüllung der folgenden Zwecke:
1. Hauptzwecke der Verarbeitung: Zur Erbringung notarieller Dienstleistungen gemäß den geltenden gesetzlichen Bestimmungen. Hierzu gehören insbesondere: die Erstellung und Führung notarieller Akten; die Vorbereitung von Urkunden, Protokollen, Bescheinigungen und sonstigen öffentlichen Urkunden; die Erfüllung gesetzlicher Verpflichtungen gegenüber zuständigen Behörden; die Überprüfung der Identität, Geschäftsfähigkeit und rechtlichen Legitimation der Beteiligten; die Führung und Aufbewahrung notarieller Register und Archive gemäß den gesetzlichen Vorschriften.
Diese Tätigkeiten umfassen unter anderem Rechtsgeschäfte zur Übertragung von Eigentumsrechten, wie: Kaufverträge; Schenkungen; Tauschverträge; Eigentumsübertragungen aufgrund von Erbschaften oder Versteigerungen; sowie ferner: Treuhandverhältnisse (Fideicomisos); Begründung von Eigentumsregimen im Wohnungseigentum bzw. Gemeinschaftseigentum; Testamente; Nachlass- und Erbverfahren; Hypothekenbestellungen; Hypothekenlöschungen; Beglaubigungen und Bestätigungen von Unterschriften; notarielle Tatsachenfeststellungen; Beglaubigungen und Vergleich von Dokumenten.
2. Sekundäre Zwecke der Verarbeitung: Zusätzlich und ausschließlich mit vorheriger Zustimmung der betroffenen Person können ihre personenbezogenen Daten für folgende Zwecke verarbeitet werden: institutionelle statistische Zwecke; Verbesserung der angebotenen Dienstleistungen; berufliche und fachbezogene Informations- und Kommunikationszwecke. Gegebenenfalls können diese Zwecke durch die Verwendung zuvor anonymisierter bzw. nicht mehr personenbezogener Daten (dissoziierter Daten) erfolgen, gemäß Artikel 9 Absatz III der LFDPPP.
Die Verarbeitung personenbezogener Daten beschränkt sich ausschließlich auf die Erfüllung der vorstehend beschriebenen Zwecke und erfolgt in einer erforderlichen, angemessenen und relevanten Weise gemäß Artikel 12 der LFDPPP. Wir bemühen uns sicherzustellen, dass personenbezogene Daten korrekt, vollständig, richtig und aktuell sind, gemäß Artikel 10 der LFDPPP. Darüber hinaus haben wir angemessene Maßnahmen ergriffen, um deren Richtigkeit zu überprüfen und dauerhaft sicherzustellen, soweit dies für die vorgesehenen Zwecke erforderlich ist.

Mit wem teilen wir Ihre personenbezogenen Daten und zu welchen Zwecken?
Ihre personenbezogenen Daten werden ausschließlich durch den Verantwortlichen sowie durch das dieser Notariatskanzlei zugehörige Personal verarbeitet, soweit dies zur Erstellung der von Ihnen beantragten oder von Ihnen mitgetragenen notariellen öffentlichen Urkunden erforderlich ist.
Ihre personenbezogenen Daten werden daher grundsätzlich nicht an Dritte außerhalb dieser Notariatskanzlei übermittelt, es sei denn, dies ist zur Erfüllung gesetzlicher Verpflichtungen gegenüber Finanzinstituten und/oder zuständigen Behörden erforderlich, insbesondere gegenüber Steuerbehörden, Verwaltungsbehörden, Ermittlungs- und Strafverfolgungsbehörden, Registerbehörden und/oder Justizbehörden.
Jede Person, die in irgendeiner Phase der Verarbeitung Ihrer personenbezogenen Daten beteiligt ist, ist verpflichtet, strikte Vertraulichkeit zu wahren, auch nach Beendigung ihres Vertrags- oder Dienstverhältnisses mit dem Verantwortlichen, gemäß Artikel 20 der LFDPPP.
Personenbezogene Daten können ohne Einholung einer zusätzlichen Einwilligung an Finanzinstitute und/oder Steuerbehörden, Verwaltungsbehörden, Ermittlungs- und Strafverfolgungsbehörden, Registerbehörden und/oder Justizbehörden übermittelt werden, sofern dies gesetzlich vorgeschrieben oder für die rechtliche Wirksamkeit und Formalisierung notarieller Vorgänge erforderlich ist.
In allen anderen Fällen wird, sofern erforderlich, die ausdrückliche Einwilligung der betroffenen Person eingeholt, gemäß den Bestimmungen der Artikel 35 und 36 der LFDPPP.

Wie können Sie die Nutzung oder Offenlegung Ihrer personenbezogenen Daten beschränken und Ihre ARCO-Rechte hinsichtlich der Verarbeitung Ihrer Daten ausüben?
Sie oder gegebenenfalls Ihr gesetzlicher Vertreter können die Nutzung oder Offenlegung Ihrer personenbezogenen Daten beschränken, Ihre ARCO-Rechte (Recht auf Auskunft, Berichtigung, Löschung und Widerspruch) gemäß den Artikeln 28 und 31 der LFDPPP ausüben sowie Ihre erteilte Einwilligung zur Verarbeitung Ihrer personenbezogenen Daten widerrufen.
Die Ausübung dieser Rechte kann über folgende Wege erfolgen:

Die Nutzung dieser Technologien erfolgt stets unter der Aufsicht und Kontrolle des hierzu befugten Personals und ersetzt nicht die menschliche Prüfung, Bewertung oder Entscheidungsfindung, sofern diese aufgrund der Art und des Umfangs der notariellen Dienstleistung erforderlich ist.
